Emefiele challenges EFCC statements, cites torture

His lead counsel asked the court to reject statements the Economic and Financial Crimes Commission wants to tender as evidence. The defence argued the documents were not made freely.

The lawyer told the court the statements were obtained under oppressive and dehumanising conditions. He said Emefiele was held incommunicado for more than 157 days before making them.

On that basis, the defence asked the judge to rule the statements inadmissible. Such evidence can only be used if the court is satisfied it was given voluntarily.

A trial within a trial

To resolve the dispute, the court ordered a trial-within-trial. This is a mini-hearing held to decide whether a contested statement was made under duress.

Until that question is settled, the disputed statements cannot be admitted into the main fraud case. The procedure is common in Nigerian criminal trials where confessions are challenged.

Conflicting accounts

The case has produced competing claims about how evidence was gathered. A co-defendant earlier told the court he was pressured to implicate Emefiele and that investigators dictated parts of his statement.

The EFCC has rejected the allegations of coercion. A commission witness testified that statements were taken openly, with lawyers present, and insisted no threats were used.

The agency maintains that the documents were given freely and should stand as evidence. The judge will weigh both sides during the trial-within-trial.
